Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FireFoundry platform, website, and related services ("Services") provided by Firebrand Analytics LLC ("Firebrand", "we", "us"). By accessing or using the Services, you agree to be bound by these Terms.
1. Beta Program
FireFoundry is currently in private beta. Beta access is granted at our discretion and may be revoked at any time. The platform is provided "as-is" during the beta period. Features, APIs, and pricing are subject to change. We appreciate your feedback and patience as we refine the platform.
2. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials and API keys
- All activity that occurs under your account
- Ensuring your use of the platform complies with applicable laws and regulations
- Managing your own AI provider API keys and associated costs (BYOK model)
3. Acceptable Use
You agree not to:
- Use the Services to build agents that violate applicable laws or regulations
- Attempt to reverse engineer, decompile, or extract source code from the platform
- Circumvent or disable security features, access controls, or usage limits
- Use the Services to generate content that is harmful, deceptive, or violates third-party rights
- Resell, sublicense, or redistribute the platform without written authorization
- Interfere with or disrupt the integrity or performance of the Services
4. Your Data
You retain all rights to the data you process through the FireFoundry platform, including agent code, entity graph data, working memory contents, and AI model outputs. FireFoundry is deployed in your infrastructure -- your data remains under your control.
We do not access your application data unless you explicitly request support assistance. See our Privacy Policy for details on what information we collect and how we use it.
5. Intellectual Property
The FireFoundry platform, including its software, documentation, design, and trademarks, is the intellectual property of Firebrand Analytics LLC. These Terms grant you a limited, non-exclusive, non-transferable license to use the platform for its intended purpose during the term of your account.
Agent bundles and applications you build on the platform are yours. We claim no ownership over the code you write, the AI agents you deploy, or the outputs they produce.
6. Third-Party Services
FireFoundry integrates with third-party AI providers (e.g., OpenAI, Anthropic, Google) through your own API keys. Your use of these providers is governed by their respective terms of service. We are not responsible for the availability, performance, or policies of third-party providers.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service, particularly during the beta period. We may perform maintenance, deploy updates, or modify features with reasonable notice. Service level agreements (SLAs) are available for Enterprise tier customers under separate agreements.
8. Limitation of Liability
To the maximum extent permitted by law, Firebrand Analytics LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Services.
Our total liability for any claims related to the Services shall not exceed the fees you paid to us in the twelve months preceding the claim, or $100 USD if no fees were paid (e.g., during the free beta period).
9. Termination
Either party may terminate these Terms at any time. You may close your account by contacting us. We may suspend or terminate your access if you violate these Terms or if we discontinue the beta program. Upon termination, your license to use the platform ceases and you should export any data you wish to retain.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Wisconsin.
